Today's real estate and construction
contracts frequently include a clause requiring mediation prior to
arbitration or litigation. In
many cases a mediator is selected from a panel of specialists in
that field. Mr. Boss has been arbitrating and mediating cases
in construction, real estate and business law for more than 17
years.
Mediation permits a free exchange and discussion of the strengths
and weaknesses of the case. Mr. Boss, through his
education and training, has insight on a variety of techniques which
allow him to assist clients by developing creative ways to reach a
successful resolution of disputes through the mediation process. He
focuses the involved parties on identifying the key issues
of a dispute and how it might be resolved in a timely and creative manner.
Mr. Boss is experienced in facilitating mediations and
maintains active memberships with several professional
organizations. In addition to his legal and technical
experience, Mr. Boss is a panel member of the
National Conflict Resolution Center (NCRC), a panel member of the
San Diego Superior Court mediation and arbitration panels, a panel
member of the Real Estate
Mediation Center, of the San Diego Association of Realtors (SDAR). He
authored, "Mediation - A Lawyer's Perspective", for the Journal of
the Litigation Section, of the State Bar of California. Mr.
Boss is also a member of the Association for Conflict Resolution (ACR).
